Terms of use

1. About These Terms

These Terms of Use govern your use of Maxvarv. By creating an account or using the service, you agree to these Terms and acknowledge the Privacy Policy. If you do not agree, do not use Maxvarv.

2. Eligibility

You must be at least 13 years old to use Maxvarv. If applicable law requires parental or guardian consent for you to use the service or for your personal data to be processed, you may use Maxvarv only with that consent.

3. Your Account

You are responsible for providing accurate account information, keeping your sign-in credentials secure and for activity carried out through your account. Notify Maxvarv at hej@maxvarv.se if you believe your account has been accessed without authorization.

4. Riding Safety

Maxvarv is a ride-tracking, analysis and Community tool. It does not replace safe riding practices, professional instruction, official competition rules, navigation equipment, vehicle maintenance, protective equipment or emergency services. Always ride according to your ability, conditions and applicable laws and rules. Do not interact with the app in a way that distracts you while riding.

5. Tracking Accuracy

GPS, speed, distance, elevation, heart-rate, calorie and other measurements can be inaccurate, delayed, incomplete or unavailable because of device limitations, sensors, signal conditions, permissions or other factors. Maxvarv data should not be relied on for emergency response, medical decisions, legal compliance, race timing or safety-critical navigation.

6. Health & Fitness Information

Maxvarv may display health and fitness information obtained from supported Apple services and sensors. Maxvarv is not a medical device and does not provide medical advice, diagnosis or treatment. Seek qualified medical advice for health concerns and before undertaking activity where appropriate.

7. Community Conduct

When using Community features, you must treat other users respectfully and must not post unlawful, threatening, harassing, hateful, fraudulent, sexually exploitative or otherwise abusive content. You must not impersonate others, misuse another person's personal data, interfere with the service, attempt unauthorized access or use Maxvarv for illegal activity.

8. Your Content

You remain responsible for content you submit to Maxvarv, including comments and information you choose to share. You must have the rights needed to submit that content. You grant Maxvarv the limited rights necessary to host, process, display and transmit your content solely to operate and provide the service.

9. Gps Route Sharing

Exact GPS routes are private in Community by default. If you enable route sharing for a ride, other permitted users may be able to view that route. A shared route can reveal sensitive information such as where a ride started, ended or passed. Review a route before sharing it and disable sharing when you do not want others to see it.

10. Acceptable Use

You may not attempt to disrupt, reverse engineer where prohibited, abuse, overload or gain unauthorized access to Maxvarv or its systems. You may not use automated methods to scrape the service or collect information about other users except where expressly permitted.

11. Service Changes & Availability

Maxvarv is an evolving service. Features may be added, changed, suspended or removed, and the service may occasionally be unavailable. Maxvarv does not guarantee that every feature will always be available or error-free.

12. Account Suspension

Access may be restricted or suspended where reasonably necessary to protect users or the service, investigate suspected misuse, comply with law or address a material violation of these Terms. Where appropriate, Maxvarv may provide notice or an opportunity to address the issue.

13. Account Deletion

You may initiate permanent account deletion in the app under More > Account > Delete Account. Account deletion removes your Maxvarv account and associated cloud data subject to limited retention required by law, security or technical backup processes. Deleting your Maxvarv account does not automatically delete workouts stored separately in Apple Health.

14. Intellectual Property

Maxvarv, including its software, branding, interface and original content, is protected by applicable intellectual-property laws. Except for rights expressly granted to you to use the service, no ownership rights are transferred to you.

15. Disclaimer & Liability

To the extent permitted by applicable law, Maxvarv is provided without guarantees that it will be uninterrupted, error-free or suitable for a particular purpose. Nothing in these Terms excludes or limits rights or liability that cannot lawfully be excluded, including mandatory consumer rights. Maxvarv is not responsible for losses caused solely by inaccurate sensor or GPS data, unsafe riding, misuse of the service or circumstances outside reasonable control, except where applicable law provides otherwise.

16. Governing Law

These Terms are governed by Swedish law, without limiting any mandatory consumer protections you may have under the law of your country of residence. Disputes may be brought before the courts or consumer dispute bodies that have jurisdiction under applicable law.

17. Changes To These Terms

Maxvarv may update these Terms as the service develops. Material changes will be communicated in an appropriate way. Continued use after an updated version takes effect may constitute acceptance where permitted by applicable law.

19. Trail Map, Photos And Shared Places

You are responsible for what you post (text, photos, places) and for having the right to share it. Do not post photos where other people can be identified without their permission. Information about places comes from other users and may be wrong or out of date. Riding motor vehicles in the terrain usually requires the landowner's permission (in Sweden: the Off-Road Driving Act). You are responsible for checking the rules and having permission before you ride. Maxvarv is not responsible for whether riding is allowed at a place. We may remove places, photos and comments that are reported, that appear to encourage illegal riding or that break these Terms, and suspend accounts that repeatedly break them.

20. Social Media And Video Links

You can add your user names on Instagram, YouTube, TikTok and Facebook to your profile, and a link to a YouTube video to a ride. You may only link to your own accounts and to videos you have the right to share. You must not impersonate anyone or link to content that breaks section 7. Links open services that Maxvarv does not control – their own terms and privacy policies apply there, and Maxvarv is not responsible for their content. We may remove links that are reported or that break these Terms.
